The Croatian Energy Regulatory Agency, pursuant to Article 61, paragraph 1 and Article 112, paragraph 1, subparagraph 1, item 14 of the Electricity Market Act (Official Gazette, No. 111/21), has adopted the Rules on the Change of Supplier and Aggregator (Official Gazette, No. 84/2022, hereinafter: the Rules).
The Rules shall apply in the procedure:
1. Changes of supplier where the Network User submits a request for the conclusion of a new Electricity Supply Contract or a new contract regulating the purchase of electricity:
- with a new supplier who is not subject to a public service obligation
- with a new supplier who provides a supply service within the framework of the general service
2. Changes of aggregators
Supplier change procedure at HV
- The end customer submits a request to conclude a new Electricity Supply Contract with the newly selected supplier.
- The new supplier, within 2 working days of receiving the request to conclude the contract, submits a request to HOPS for data compliance verification electronically here.
- Upon the receipt of a valid request for data compliance verification, HOPS will, within 3 working days, or no later than the 22nd of the month preceding the month of application of the new Electricity Supply Contract, submit a confirmation of data compliance.
- If the data is not compliant, HOPS will, within 3 working days, notify the new supplier of the non-compliant data.
- The new supplier is obliged to eliminate the deficiencies within 3 working days of receiving the notification from HOPS and notify HOPS thereof; otherwise the supplier change procedure will be suspended.
- After the new supplier has eliminated the deficiencies, within 3 working days of the notification, HOPS will issue a certificate of data compliance.
- The new supplier is obliged to deliver to the end customer, within 2 working days, a confirmation of acceptance of the request to conclude a new Electricity Supply Contract.
- The new supplier is obliged to notify HOPS, within 2 working days, of the date of conclusion of the new Electricity Supply Contract and the date of beginning of its application.
- The new Electricity Supply Contract is considered concluded on the date of sending the new supplier's confirmation of acceptance of the request to conclude a new Electricity Supply Contract to the new customer.
- After procedure of the supplier change is completed, HOPS is obliged to notify the existing supplier that the supplier change has been made.
The change of supplier is carried out on the first day of the month, i.e. on the day of the beginning of the application of the new Electricity Supply Contract.
The delimitation of consumption between the existing and new suppliers is applied on the day of the beginning of the application of the new Electricity Supply Contract.
If HOPS determines that a procedure of supplier change initiated by another supplier is underway at the final customer's billing metering point, the supplier change procedure initiated by a later request for the conclusion of the Electricity Supply Contract is suspended.
Procedure for sending notices of termination of the Electricity Supply Contract:
- The supplier sends Notices of termination of the Electricity Supply Contract to HOPS electronically, and the original thereof to the address: HOPS d.d, Kupska 4, 10 000 Zagreb (for Market Department).
- HOPS will receive Notices of termination of the Electricity Supply Contract in accordance with Article 18, paragraph 3 of the Rules on changing suppliers and aggregators, i.e. no later than 2 business days before the termination of the Electricity Supply Contract.
- HOPS notifies the supplier via email of the validity and duly received notice of termination of the Electricity Supply Contract.
- HOPS registers the network user as a user of the public electricity supply service on the first day following the termination of the Electricity Supply Contract, and no later than the next working day notifies the supplier within the public electricity supply service of the termination of the Electricity Supply Contract.
